  • Eric Foster is scheduled to go on trial on Sept. 19 for the murder of Trinity Monique Hanna.
Foster appeared in Kern County Superior Court on Monday for his arraignment in the torture and murder of the three-year-old Taft girl.
Foster, who turned 28 on March 5, has been in custody since Jan. 25, 2011, the day after Trinity was pronounced dead in the emergency room of a Bakersfield hospital.
He is being held without bail and could face the death penalty because of the torture and murder allegations.
The Kern County District Attorney's Office has not decided whether or not it will seek the death penalty against Foster.
Assistant District Attorney Scott Spielman, who is prosecuting the case, said no final decision has yet been made on whether or not to seek the death penalty.
Trinity's mother, Angela Monique Hanna, has already pleaded no contest to child abuse charges and is required by her plea bargain to testify against Foster at his trial in exchange for receiving no more than 10 years in prison.
