Carlos Garcia charged with second-degree murder for death of Francisco De la Cruz

An alleged drunk driver accused of killing a Taft man on Highway 119 last summer is going on trial on second degree murder charges and three other felony counts.

Carlos Bonifacio Garcia, 27, is scheduled to be arraigned on Jan. 29 in Kern County Superior Court in Bakersfield after a judge ruled at his preliminary hearing on Wenesday that there was sufficient evidence to order him to stand trial.

Garcia, 27, is accused of driving drunk on Highway 119 just west of Stine Road on July 16 when his vehicle crashed head-on into a pickup driven by Francisco De La Cruz, 25.

Witnesses told Bakersfield Police that Garcia was weaving in an out of traffic in the eastbound lanes when his car crossed into the westbound lanes and hit De la Cruz' truck.

In addition to the murder charge, Garcia is charged with gross vehicular manslaughter, drunk driving causing serious bodily injury and driving on a license suspended or refusing a chemical test

Garcia has pleaded not guilty to all counts,

He was arrested two days after the fatal crash when he was released from a hospital.

He has been held since on $1,050,000 bail.
